Conditions for Supply, Installation, and Service delivery

All application for the execution of works will be dealt with in the order of priority or date, but the company reserves the right of executing the work in the manner and at the time best in its convenience.

The company shall have the right forthwith and without notice to terminate the agreement for any breach by the consumer to the conditions of supply, but without prejudice to any antecedent right against the consumer including the right to take court proceedings

All quotations shall be billed and payment done prior to starting the work while servicing invoices shall be made at the end of the work done. Payment shall be done by cash, cheque at our offices (Teller), bank transfer, M-Pesa and direct bank deposit in KENYA COMMERCIAL BANK Account no. 1213677009 or MPESA BUY GOODS & SERVIVES TILL NO: 7135684

If any account is overdue electricity maybe disconnected and only be reconnected upon payments of the outstanding bills and requisite reconnection fees.

Customers shall be bound by the Energy Act 2019 Vol. 1.

(A) No consumer shall use or is permitted to use, any electricity supplied in pursuance of this application except for such use as specified by him in his application.

(B) No consumer shall convey, or permit to be conveyed by any means whatsoever, for use outside his plot, or for sale,

The company shall be responsible for all electricity supply facilities up to the Outlet receptacles. Thereafter the responsibilities and risks pass to the customer in cases where a load or extension maybe added to the system.

(A) It is unlawful for anyone to tamper with an Energy meter which is the property of the KPLC. Should there be tampering with the meter the Company will disconnect services and lodge a criminal complaint against the customer to KPLC. In addition, the customer shall be required to pay any applicable penalties prior to any reconnection of services.

It is the responsibility of the customer to give access to the meter and premises to the Company’s authorized agents who shall reserve the right to disconnect from the mains in the event of no such access being granted. Such agents shall at all times identify themselves.

Except in cases of emergencies, the Company shall endeavor to notify of any service Interruption.

Customers may lodge complaints with and report any corrupt practices involving the Company’s Employees/agents at any service or drop confidential note at our corruption reporting boxes.

The company reserves the right to reject your application or withdraw the connection for any false information given or default on payments for services rendered for your other existing Services.

The company may from time to time amend the terms and conditions set out herein provided that no amendment shall come into force except with prior notice of at least three months.

The customer shall give a written notice of 30 working days, where services of Expertech are no longer required and terminate the contract surrender deposit receipt and request for refund.

15. In cases of meter theft, a police abstract should be produced before processing replacement and issuing another meter from KPLC.

a) To pay the Charges of installation and invoices made in respect to the services done b) Allow authorized Expertech Electrical contractors Staff entry into the premise of supply for purposes of inspection of the installations to ascertain that the same is in good working condition.

1. We will not bear the cost of any unpaid cheques; we will invoice you the exact bank charges raised by the bank which will be exclusive of VAT.
2. Please pay within the invoice Due date from the date of invoice, You will be charged an extra storage charge of 10% for the products not collected within 30 days of the date on invoice, the goos will be stored for a maximum of 90 days starting from the date of invoice after which the company will not be liable for these products.
3. All Goods Sold remain the property of Expertech Electrical Contractors Ltd untill fully paid even if further work has been carried out on them.
4. Our Resonsibility ceases when goods are handed to transport company/your authorised representative. No clain regarding quantity,measurement, loss or damage will be entertained after goods have left the yard/building premises not unless it is Expertech Electrical Contractors Doing Transportation.
5. Please quote invoice number when remitting funds and remember that All Payments and Cheque are made to the Company Name.
6. Goods once sold are not returnable or exchangable, any goods returnedbecause of being misshandled by the customer will be subject to a 10%handling charge if accepted back.

b) You agree to notify Expertech Electrical Contractors Ltd immediately of the occurrence of the foregoing.

c) For purposes of this Section 13, a “Government Official” means any employee or officer of a government in any country, including any federal, regional or local department, agency, or enterprise owned or controlled by such government; any official or employee of a political party; any official or employee of a public international organization; any candidate for political officer; and any person acting in an official capacity for, or on behalf of, such a person.

14. Enforcement of Terms and Conditions

These Terms and Conditions are governed and interpreted pursuant to the laws of Kenya, without reference to its conflicts of law principles, to the extent such principles would apply the law of any other jurisdiction.

All disputes arising out of or relating to these Terms and Conditions shall be finally resolved by arbitration before a single arbitrator conducted in the English or Swahili Language in Kenya under the Kenyan Laws. The parties shall bear equally the cost of the arbitration (except that the prevailing party shall be entitled to an award of reasonable attorneys' fees incurred in connection with the arbitration in such an amount as may be determined by the arbitrator).
