If you have a separate written or click-through agreement with
Expertech Electrical Contractors Ltd regarding specific services or
deliverables, that agreement shall prevail over these Terms in the
event of any conflict.
1. Conditions for Supply, Installation, and Service Delivery

Applications for work are processed in order of receipt. However, Expertech reserves the right to schedule execution at its professional discretion.
2.
Expertech may suspend or terminate services upon written notice if you materially breach these conditions and fail to remedy the breach within seven (7) business days, without prejudice to its right to seek legal or equitable redress.
3.
All quotations must be paid in full before commencement of works unless otherwise agreed in writing. Service-related invoices are payable immediately upon completion. Payments can be made via:

Overdue accounts may result in suspension of technical services, active project engineering, and the lawful application of reconnection or administrative penalties.
5.
Customers are bound by the provisions of the Energy Act, 2019 and all relevant regulatory frameworks issued by the Energy and Petroleum Regulatory Authority (EPRA).
6.
Consumers may only use electricity as specified in their engineering application. Supply must not be unauthorizedly conveyed, tapped, or resold outside their registered premises.
7.
Expertech’s infrastructural responsibility ends at the designated consumer outlet receptacles or technical coupling points. Beyond this, operational risks pass entirely to the customer.
8.
Tampering with utility meters or infrastructure is a criminal offense under Kenyan law and will be escalated immediately to relevant law enforcement authorities.
9.
Customers must grant authorized, verified Expertech personnel safe access to premises at reasonable times for audits, technical inspections, or necessary disconnections.
10.
Except in emergency situations or under force majeure events, Expertech will endeavor to give prior notice of scheduled technical service or installation interruptions.
11.
Complaints or compliance feedback reports may be securely lodged directly with Expertech through designated reporting lines.
12.
Expertech reserves the right to reject service applications or withdraw field engineering operations for material misrepresentation of information, payment defaults, or infrastructure misuse.
13.
Terms may be amended with appropriate notice published via the online portal or communicated directly to users in accordance with statutory consumer protections.
14.
Customers may terminate recurring maintenance services by giving 30 working days’ written notice and surrendering relevant receipts for processing eligible refunds (if applicable).
15.
In cases of equipment or meter theft on the customer's site, a certified Police Abstract is strictly required before technical replacement procedures can commence.
16.
Data Governance and Project Contracts: To provide custom energy analysis, solar profiling, and engineering solutions, Expertech processes technical account metrics and utility data.

All customer energy auditing, profile analytics, and technical representation operations are conducted in strict compliance with the Kenya Data Protection Act, 2019 and cross-referenced under our Privacy Policy.
•
Specific parameters concerning utility liaison, energy billing audits, and direct representation authorizations are systematically embedded within, and governed by, the definitive physical Work Contracts or Supply Application Forms executed upon service initialization.
2. Conditions for Sale of Goods and Services
1.
Dishonored cheques will attract full recovery of bank transactional charges plus associated administrative fees (exclusive of VAT).
2.
Goods must be collected within 30 days of invoice date or a 10% storage fee will apply. Uncollected components after 90 days will no longer be the responsibility of Expertech and may be liquidated to clear accrued costs.
3.
Goods remain the absolute legal and equitable property of Expertech until full and final payment is received.
4.
Risk and liability pass to the customer once technical assets are delivered to the site or handed over to your designated transporter or agent.
5.
Goods once sold are non-returnable or exchangeable unless accepted at Expertech’s absolute technical discretion, which returns may attract a 10% restocking and handling fee.
3. Copyright and Trademarks
All content on this website

including text, graphics, images, data configurations, energy calculations, reports, and digital scripts, is
the exclusive property of Expertech Electrical Contractors Ltd, its affiliates,
and licensors and is protected under the Kenya Copyright Act (Cap 130),
Trademarks Act (Cap 506), and international intellectual property conventions.
“Expertech Electrical Contractors Ltd” and its stylized design emblems are registered
trademarks. Other product names mentioned on the portal are trademarks of their
respective manufacturing owners.
4. Website Use and Services

Services on this portal may be publicly accessible informational modules, project-based procurement contracts, or subscription-based calculations.

Your right to use this platform is personal, non-transferable, revocable, and non-exclusive.

Client login credentials must be kept strictly confidential. Expertech is not liable for losses resulting from unauthorized access or use of your portal account.
5. Limitation of Liability
ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
Expertech does not warrant that:

Information will always be error-free or perfectly up to date;
•
Website sizing systems, calculators, or link features will be uninterrupted;
•
Technical software or data output defects will always be instantly corrected;
•
The hosting architecture and databases are completely immune to cyber-threats or harmful scripts.
Liability Cap: To the maximum extent permitted under the Consumer Protection Act, 2012, and the Laws of Kenya, Expertech’s total cumulative liability for proven contractual damages shall not exceed the total fees paid by the client to Expertech for the specific service under dispute during the preceding twelve (12) months. Nothing in these terms limits liability for death, personal injury, or fraud resulting directly from Expertech's proven gross negligence or willful misconduct.
6. Submissions
By submitting load profiles, technical requests, feedback, or data metrics to this website, you grant Expertech a worldwide, royalty-free, perpetual license to securely analyze, process, and preserve it for standard internal business purposes and compliance reporting.
You warrant that you own or possess the legitimate legal right to upload and share such configuration metrics.
7. User Conduct
You may not use this site or its sizing utilities for unlawful, harmful, or fraudulent activities. Prohibited behavior includes unauthorized script-injection, DDOS operations, data scraping, or distributing malicious computer code.
Expertech reserves the right to immediately remove offending contents, log technical details for regulatory authorities, or suspend user access without liability.
8. Third-Party Links
This platform contains operational hyperlinks to external stakeholders (e.g., EPRA, Kenya Power). Expertech exerts no administrative control over external platforms and is not responsible for their independent contents, cookies, or privacy terms.
9. Dispute Resolution and Governing Law
These Terms and Conditions are governed exclusively by, and construed in accordance with, the Laws of the Republic of Kenya.
Any dispute arising under these terms shall first be subject to amicable consultations. If unresolved within thirty (30) days, the matter shall be referred to arbitration in Kenya conducted in the English language in accordance with the provisions of the Arbitration Act (Cap 49, Laws of Kenya). The Arbitrator’s ruling shall be final and binding on both corporate parties.
10. Miscellaneous

These Terms do not establish any legal partnership, joint-venture, agency, or employment relationship between Expertech and the client.
•
Rights under these conditions may not be assigned to third parties without the prior written consent of Expertech.
•
Legal notices must be issued in writing via verified physical delivery or corporate email endpoints and are effective upon receipt.
•
Structural section headings are utilized for reading convenience only and do not modify statutory interpretations.
11. Entire Agreement
These Terms, along with the integrated Privacy Policy, constitute the entire legal agreement between you and Expertech Electrical Contractors Ltd regarding website usage, portal interactions, and fundamental service provisioning, superseding all prior verbal or written communications.
